PLEASE READ THESE TERMS OF USE CAREFULLY. BY ACCESSING OR PARTICIPATING IN Kush Alley Collective, YOU AGREE TO BE BOUND BY THESE TERMS OF USE AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO THESE TERMS OF USE, DO NOT PARTICIPATE IN Kush Alley Collective.
These Terms of Use apply to your access to, and participation in, Kush Alley Collective which is operated by Kush Alley Inc., or its respective subsidiaries, licensees and affiliated companies (collectively, “Kush Alley”) in the State of California. These Terms of Use do not alter in any way the terms or conditions of any other agreement you may have with Kush Alley for other products and services. Kush Alley reserves the right to change, modify and/or eliminate Kush Alley Collective and/or all or any portion of these Terms of Use or any policy, FAQ, or guideline pertaining to Kush Alley Collective at any time and in its sole discretion. Any changes or modifications will be effective immediately upon posting the revisions to www.kushalleyca.com, and you waive any right you may have to receive specific notice of such changes or modifications. Your participation in Kush Alley Collective confirms your acceptance of these Terms of Use and any such changes or modifications; therefore, you should review these Terms of Use and applicable policies and FAQs frequently to understand the terms and conditions that apply to Kush Alley Collective. If you do not agree to the Terms of Use, you must stop participating in Kush Alley Collective.
Kush Alley Collective is intended for personal use only. Commercial use is prohibited. This program is not targeted towards, nor intended for use by, any adult-use customers under the age of 21, or medical patients at least 18 years of age with a valid California medical marijuana card.
Kush Alley Collective is one way in which Kush Alley endeavors to reward and thank loyal customers for patronizing our business, and purchasing products at Kush Alley retail locations “Stores”. Members of Kush Alley Collective are able to earn and accumulate “Points” that can be redeemed for Kush Alley Collective benefits, also known as “Rewards or Loyalty,” at participating Kush Alley Stores in the State of California. Unfortunately, not all Stores have the ability to award Points or honor Rewards at this time.
Joining Kush Alley Collective Society
There are two (two) ways to enroll in Kush Alley Collective and begin accumulating Points:
Join Kush Alley Collective by visiting a Kush Alley retail location and making a qualifying purchase or visiting www.kushalleyca.com. The registration process may require that you provide the following information: email address, physical address, telephone number, birthday, name, and marketing preferences.
EARNING POINTS
The benefits that are available to you through Kush Alley Collective are based on the number of “Points” that you earn. You can earn Points by making qualifying purchases in person at participating Kush Alley Stores.
You will earn Points based on the value of your purchase at the rate of one (1) Points for each One Dollar ($1.00) you spend at participating Kush Alley Stores, some exclusions apply. Taxes, tips, donations, and fees, including without limitation, shipping and handling fees, gift wrapping fees, delivery fees, and bag fees, may also be excluded and ineligible for Point accrual. Points may be earned and awarded in fractional amounts depending on the value of your purchase. Generally, Points for qualifying purchases from participating Stores are automatically added to your account within twenty-four (24) hours. From time to time, we, or others acting with our permission, may offer you special promotions that offer you “Promotional Points.” Promotional Points, such as “bonus” Points, will be awarded as described in the applicable promotional offer and will be subject to any additional terms set forth in the promotional offer.
If you void a purchase made at a Kush Alley store, Kush Alley Collective will deduct the Points that you were awarded for that purchase, potentially resulting in a negative Point balance on your account. If you return merchandise that you purchased, Kush Alley will deduct Points from your account.
EXPIRATION OF Kush Alley Collective loyalty POINTS
Starting January, 1st 2024 and moving forward, all Kush Alley Collective Points earned under the Kush Alley Collective App will be valid for one (1) year from the date the points are acquired at your Kush Alley dispensary. After one (1) year, the points will expire and cannot be redeemed. For avoidance of doubt: if a guest earns 100 Kush Alley Collective points on March 18, 2024, the 100 points will expire if not redeemed in a Kush Alley dispensary by March 18, 2025. There are no exceptions or exclusions to this policy.
KUSH ALLEY COLLECTIVE LEVELS
You can view and track your Point balance and available Rewards at a Kush Alley location by asking a sales associate and providing your identifying information. Kush Alley reserves the right to change the number of benefit levels and to change the benefits and Rewards associated with each level in its sole discretion at any time.
To qualify for the birthday Reward, you must join Kush Alley Collective at least seven (7) days before your birthday and have made at least one Point-earning transaction. Your birthday Reward will be automatically added to your account on your birthday (that is, the birthday date of record that you provided in your Kush Alley Collective account information), and is valid only on that date. You will receive only one (1) birthday Reward regardless of the number of accounts you have.
MISCELLANEOUS
There are no membership fees associated with Kush Alley Collective. Points accumulated under the program are promotional and have no cash value.
Your Points, Rewards, and your account under Kush Alley Collective are personal to you and may not be sold, transferred or assigned to, or shared with, family, friends or others, or used by you for any commercial purpose. You may have only one (1) Kush Alley Collective account that is personal to you.
Without notice to you, Kush Alley reserves the right to suspend and/or terminate your account and/or your participation in Kush Alley Collective if Kush Alley determines in its sole discretion that you have violated these Terms of Use, you have more than one (1) account, or that the use of your account is unauthorized, deceptive, fraudulent or otherwise unlawful. Kush Alley may, in its sole discretion, suspend, cancel or combine accounts that appear to be duplicative. In the event that your participation in Kush Alley Collective is terminated, then all accumulated Points in your account are void.
Without notice to you, Kush Alley also reserves the right to “unregister” and make ineligible for the Kush Alley Collective account that has been inactive for one (1) year. Inactive is defined as no Points earned. In the event that your account is unregistered or rendered inactive, then all accumulated Points in your account are void.
Kush Alley reserves the right to terminate, discontinue or cancel the Kush Alley Collective at any time and in its sole discretion without notice to you.
